Canada fines Peken Global (KuCoin) $14M for AML lapses, sets major crypto enforcement precedent.

What to Know:
  • FINTRAC fines Peken Global, KuCoin’s operator, for AML failures.
  • Largest crypto fine by FINTRAC at $14 million USD.
  • Potential shift in global crypto compliance standards.

Canada’s financial intelligence regulator, FINTRAC, has fined Peken Global Limited, KuCoin’s operator, C$19.55 million for failing to comply with anti-money laundering obligations from 2021 to 2024.

This penalty highlights FINTRAC’s commitment to stringent compliance, potentially influencing operational practices of crypto exchanges globally, although no immediate asset-level enforcement has occurred.

FINTRAC penalized KuCoin operator Peken Global Limited with a $14 million USD fine for anti-money laundering violations in Canada from 2021 to 2024.

The event highlights increased scrutiny on crypto exchanges, setting a precedent for stricter global regulations and impacting exchange compliance strategies.

FINTRAC Imposes Record $14M Fine on KuCoin Operator

FINTRAC, Canada’s financial intelligence unit, has imposed a C$19.55 million fine on KuCoin’s operator, Peken Global Limited, citing anti-money laundering failures. The fine results from operations between 2021 and 2024.

Peken Global Limited, incorporated in Seychelles, was penalized for failing to report crypto transactions and omitting 33 suspicious activity reports. This penalty marks FINTRAC’s largest crypto-related enforcement action.

KuCoin Appeals Fine Amid Crypto Compliance Concerns

Following the fine, Peken Global has appealed to the Federal Court, seeking a review. Market participants showed concern over KuCoin’s compliance strategy, although asset-level enforcement has not affected BTC or ETH directly.

FINTRAC’s move aligns with international FATF standards and signals a tightening of crypto regulations globally. The case highlights potential implications for crypto exchanges operating without stringent compliance frameworks.

“We are firm in ensuring that businesses continue to do their part and will take appropriate actions when needed.”

Largest Canadian Crypto AML Fine as Regulatory Warning

This penalty is unprecedented as Canada’s largest enforcement in crypto AML, serving as a stern warning to other exchanges. Similar past actions involved smaller fines on foreign exchanges operating locally.

The appeal by Peken Global could reshape future regulatory practices if successful. Historical trends suggest increased vigilance, with governments possibly deploying more comprehensive AML audits in the crypto sector.
